These Terms of Use ("Terms") govern your access to and use of the TrustyFans™ website and services (collectively, "TrustyFans," "we," "our," or "us"), which are operated by NextGen Web, LLC, a Delaware limited liability company.

TrustyFans™ is a trademark and trade name of NextGen Web, LLC.

1. Definitions

In these Terms:

• "TrustyFans" refers to the website www.trustyfans.com and all related services
• "NextGen Web, LLC," "we," "us," or "our" refers to the legal entity that owns and operates TrustyFans
• "User" means any person who uses the platform, including both Creators and Fans
• "Fan" means a User who uses TrustyFans to explore or review content creators but does not upload or promote content
• "Creator" means an independently registered User who uploads or promotes content on the platform
• “Business User” means a User who accesses or uses the platform in connection with a business, profession, or commercial activity other than operating a Creator profile.
• "Content" means all information, media, text, images, or other materials posted to the platform by Users
• “User Content” means any Content submitted, uploaded, or made available by Users on the platform, including but not limited to profile information, images, comments, and reviews, excluding account registration information or payment data
• "Repeat Infringer" means a User who has been the subject of two or more separate instances in which their User Content was removed or access to it was disabled following a valid notice of copyright infringement, or who has otherwise been determined by us, in our reasonable discretion, to have infringed the copyrights of others on more than one occasion.

2. Acceptance of Terms

By accessing or using TrustyFans, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the platform.

3. Eligibility

You must be at least 18 years old and legally permitted to access adult content in your jurisdiction to use TrustyFans. By accessing or registering for TrustyFans, you represent that your use of the platform is lawful in your jurisdiction, including compliance with any age, content classification, or morality-based access restrictions. You further declare, under penalty of perjury, that the date of birth you provide to TrustyFans is true and correct, that you are at least 18 years of age, and that you have read and agree to the Terms of Use and Privacy Policy.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We reserve the right to suspend or terminate accounts at our sole discretion. Creators have 30 days from the date of their account approval to fully complete their profile page. Failure to do so may result in removal of the profile, and you may be required to restart the creator verification and registration process to regain access.

5. Payments and Fees

TrustyFans does not facilitate direct payments between Fans and Creators. However, we may offer optional paid services to Creators, such as profile promotion or enhanced visibility. These services may be charged via one-time payment or subscription through third-party payment processors (e.g., Stripe, PayPal). TrustyFans is not a payment processor, escrow agent, or financial intermediary and assumes no responsibility for transactions that may occur outside the platform. We are not responsible for the performance, availability, or policies of third-party payment processors. All payment disputes must be resolved with the applicable provider.

All payments are non-refundable, except where required by law.

6. Prohibited Conduct

You agree not to:

• Upload or distribute content involving minors, non-consensual acts, or any content deemed “adult content” by TrustyFans, including but not limited to nudity or partial nudity, sexual activity, or other sexually explicit or suggestive conduct. TrustyFans reserves the sole right to determine what constitutes adult content for purposes of these Terms.
• Harass, threaten, or abuse others
• Violate intellectual property rights
• Engage in fraud, impersonation, or spam
• Attempt to circumvent platform security
• Share TrustyFans content outside the platform without permission
• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the platform
• Interfere with, disrupt, or attempt to gain unauthorized access to any part of the platform, its servers, or connected systems
• Use automated tools (including bots, scrapers, crawlers, or spiders) to access or interact with the platform without express written permission
• Introduce viruses, malware, or any other harmful code to TrustyFans
• Engage in any conduct that, in our sole discretion, violates the spirit of these Terms or our Community Guidelines

Violations may result in account suspension or termination and may be reported to law enforcement.

7. Termination

We reserve the right to suspend or terminate any account or access to the platform at our sole discretion, with or without notice, for any reason, including suspected violation of these Terms. Termination of your account does not limit either party’s rights or obligations accrued before termination.

8. Content Ownership and Licensing

Creators retain ownership of their content. By uploading content to TrustyFans, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and promote your content within and in connection with the platform. You waive any moral rights and grant us the right to use your content to promote TrustyFans on affiliated platforms, including social media and advertising. This license includes the right to use your content in promotional materials and derivative formats consistent with the features of the platform.

This license does not allow us to sell or sublicense your content outside of TrustyFans.

You are solely responsible for ensuring your content complies with all applicable laws.

9. Content Monitoring

We reserve the right, but are not obligated, to remove content. Decisions regarding content moderation are final and at our sole discretion. This includes public reviews posted on Creator profiles. Creators may request review removal when they believe a review violates these Guidelines.

10. Copyright Infringement & DMCA

NextGen Web LLC respects the intellectual property rights of others. Per the DMCA, we will respond expeditiously to claims of copyright infringement on the Site if submitted to our Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, We will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content.

If you believe that your intellectual property rights have been violated by us or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below:

• A description of the copyrighted work or other intellectual property that you claim has been infringed;
• A description of where the material that you claim is infringing is located on the Site;
• An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not we, can contact you;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;
• A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
• Your electronic or physical signature.

NextGen Web LLC may request additional information before removing any allegedly infringing material. In the event we remove the allegedly infringing materials, we will immediately notify the person responsible for posting such materials that we removed or disabled access to the materials. We may also provide the responsible person with your email address so that the person may respond to your allegations.

11. Platform Role & Section 230 Notice

TrustyFans is a neutral platform that allows Users to upload, explore, and review content. Under 47 U.S.C. § 230, we are not liable for content posted by Users. While we may moderate content, we are not responsible for user-generated material. We do not pre-screen or verify content or user identities and make no representations about the accuracy or legality of materials posted by Users. Reviews must comply with these Terms and our Community Guidelines. We may moderate or remove reviews at our sole discretion.

12. Third-Party Services

TrustyFans may include or interact with third-party services. Your use of these services is governed by their respective terms and Privacy Policy.

13. Indemnification

You agree to defend, indemnify, and hold harmless TrustyFans, NextGen Web, LLC, and our officers, agents, and affiliates from any claims or liabilities arising from your content, conduct, or violation of these Terms or applicable laws.

14. Limitation of Liability

TrustyFans is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages resulting from your use of the platform. To the maximum extent permitted by law, we shall not be liable for punitive, incidental, or special damages under any theory of liability. We do not guarantee uninterrupted or error-free access to TrustyFans. We are not responsible for any loss of data, content, revenue, or business opportunities resulting from system downtime, outages, data corruption, unauthorized access, or other technical failures. You understand and agree that your use of TrustyFans is at your sole risk and that you are responsible for backing up your content and data.

Our total liability to you for any claim shall not exceed the greater of:

• $250 (if you are a Fan); or
• $5,000 (if you are a Creator or Business User).

15. Dispute Resolution and Arbitration

Before bringing a legal claim, you agree to contact us to attempt informal resolution. If a dispute cannot be resolved informally, both parties agree to resolve it through binding arbitration under the rules of the American Arbitration Association. Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement or unauthorized access.

You waive the right to participate in any class action or representative lawsuit.

16. Governing Law

These Terms shall be governed by the laws of the State of Delaware. All legal proceedings must be brought in the state or federal courts located in Kent County, Delaware. Users accessing the platform from outside the United States are responsible for ensuring that their use complies with local laws. TrustyFans makes no representations regarding content availability or legality outside the U.S.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder will remain in full force and effect. The provisions of Sections 8, 11–16 shall survive any termination of your account or these Terms.

18. Changes to Terms

We may update these Terms at any time. We will notify users of material changes via the platform or email. Continued use of TrustyFans after changes become effective constitutes acceptance. We will provide at least 10 days’ notice for material changes.
